Terms of Service

By registering for or using TALNT ("the Service"), you agree to these Terms on behalf of yourself and the organization you represent. You represent that you have authority to bind your organization to these Terms. If you do not have that authority, do not use the Service.

TALNT is provided by GETPLNR LLC ("Company," "we," "us"). These Terms constitute a binding agreement between you and the Company.

TALNT is a software-as-a-service (SaaS) recruiting acceleration platform designed for collision repair operators, multi-shop operators (MSOs), and related automotive businesses. The platform provides tools for candidate tracking, pipeline management, automated outreach, and reporting across one or more shop locations.

To use TALNT, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your login credentials
• Promptly notify us of any unauthorized access to your account
• Be responsible for all activity that occurs under your account
• Not share login credentials with individuals outside your organization
• Not create accounts for the purpose of circumventing usage limits or fees

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, pose a risk to the platform or other users.

TALNT is offered on a subscription basis. Pricing, plan details, and billing cycles are described on the pricing page and in your account dashboard. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew automatically unless cancelled at least 24 hours before renewal
• All fees are non-refundable except as required by applicable law or as stated in our refund policy
• We may change pricing with 30 days' written notice to your account email
• Failure to pay may result in suspension or termination of access
• All prices are in USD unless otherwise stated

Payment processing is handled by Stripe. By providing payment information, you authorize Stripe to process charges on our behalf.

You agree to use TALNT only for lawful purposes and in compliance with these Terms. You must not:

• Use the platform to harass, spam, or send unsolicited communications
• Violate any applicable employment, privacy, or anti-discrimination laws
• Upload or transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to any part of the platform or its infrastructure
• Scrape, crawl, or extract data from the platform using automated means without permission
• Reverse engineer, decompile, or attempt to extract source code from the platform
• Use the platform in any way that could damage, disable, or impair its operation
• Impersonate any person or entity or misrepresent your affiliation
• Resell or sublicense access to the platform without written authorization

TALNT provides tools to help you manage candidate relationships. However:

• You are responsible for compliance. You are solely responsible for ensuring your use of TALNT complies with all applicable employment laws, equal opportunity regulations, the Americans with Disabilities Act (ADA), GDPR, CCPA, CAN-SPAM, TCPA, and any other applicable law.
• Candidate consent. Before contacting candidates via the platform's outreach features, you are responsible for confirming that appropriate consent has been obtained where legally required.
• No discriminatory use. The platform may not be used to make hiring decisions based on protected characteristics including race, gender, age, disability, national origin, or religion.
• Third-party data. If you use enrichment integrations (Apollo, People Data Labs, etc.), you must comply with those providers' terms and applicable law regarding the use of third-party contact data.

The platform uses automated tools, including artificial intelligence, to assist with reviewing, screening, scoring, and ranking applicants (an “Automated Employment Decision Tool”). These outputs are advisory only and are intended to support, not replace, human judgment — a qualified person makes the final hiring decision. As the employer/deployer, you are responsible for compliance with all laws governing automated employment decisions, including NYC Local Law 144 (bias audit and candidate notice where applicable), the EU AI Act, GDPR Article 22, and applicable EEOC/anti-discrimination requirements. You agree not to use AI outputs as the sole basis for an adverse decision and to provide candidates any notices, opt-outs, or accommodations the law requires.

TALNT is a technology platform that facilitates recruiting workflows. We make no guarantee that use of the platform will result in successful hires, reduced time-to-fill, or any specific business outcome. Results vary based on market conditions, job requirements, compensation, and other factors outside our control.

TALNT integrates with third-party services including but not limited to Indeed, LinkedIn, Apollo, People Data Labs, Resend, Twilio, Stripe, and Supabase. Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. We are not responsible for the practices or performance of third-party services.

You are responsible for obtaining any required accounts, API access, or approvals from third-party providers before using those integrations within TALNT.

Our IP: The TALNT platform, including its software, design, algorithms, content, and branding, is owned by GETPLNR LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our name, logo, or trademarks.

Your data: You retain ownership of all data you enter into TALNT, including candidate records, notes, and communications. By entering data, you grant us a limited license to process it for the purpose of providing the Service.

Feedback: If you provide suggestions or feedback about the platform, we may use that feedback without restriction or obligation to you.

Each party agrees to keep the other's confidential information secure and not to disclose it to third parties without consent. This does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETPLNR LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless GETPLNR LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party rights.

By you: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we determine continued service poses a risk. We will provide notice where feasible.

Upon termination, your right to access the Service ends. You may export your data prior to termination. Sections of these Terms that by their nature should survive termination will do so, including Intellectual Property, Limitation of Liability, and Indemnification.

These Terms are governed by the laws of the State of [STATE], without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts located in [COUNTY, STATE], and you consent to personal jurisdiction in those courts.
